After the Social Security Fairness Act was passed in January 2025, millions of Americans are now getting long-overdue Social Security benefits. This new law removes two provisions that previously reduced or eliminated Social Security benefits for public-sector retirees and their partners.
Due to this, many beneficiaries will receive retroactive payments for 2024 along with increased monthly payments.
Social Security Fairness Act
The Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO), two regulations that have significantly reduced benefits for a large number of public sector employees, have been eliminated by the Social Security Fairness Act.
The WEP reduced Social Security payments for retirees who also received a pension from a job that did not contribute to Social Security, while the GPO eliminated partner and survivor benefits for those with government pensions. These rules originally had the goal to prevent “double-dipping,” but many believed they improperly penalized retirees who had contributed to Social Security by other jobs.

New Regulation Benefits
The elimination of WEP and GPO benefits approximately 3.2 million retirees. Among them, 2.1 million public-sector retirees were previously affected by WEP, while 770,000 spouses and widows/widowers had their benefits reduced due to GPO.
Teachers, police officers, firemen, and other government employees will be most affected by this change, which ensures they will get the Social Security benefits they have earned via their payments.
Social Security Benefit Increases
Social Security benefits for many seniors are going to increase significantly. Retirees affected by WEP will receive an average increase of $360 per month, while spouses impacted by GPO will see their benefits increase by about $700 per month. Surviving spouses will get significant boost, with an average increase of $1,190 per month.
Retroactive Payments and New Benefit Schedule
- Additionally, eligible retirees will receive a lump sum payment to make up the difference in benefits for the previous year, as the law is retroactive to January 2024.
- The SSA started issuing these payments from 24th February 2025, and most recipients can expect to receive their back payments by the end of March 2025.
- Since Social Security is always paid one month behind schedule, the increased monthly payments will start in April 2025.
Do Beneficiaries Need to Take Any Action
The SSA manages the updates automatically, and the money will be deposited into the bank accounts they already have on file. However, you might receive your payment before getting an official notice from the SSA.
The SSA will send letters explaining the changes. Some persons can receive two letters: one with their new monthly benefit amount and another confirming the removal of WEP or GPO. You may verify your current benefits by contacting the SSA at 800-772-1213 or by logging into your SSA account online.
Possible Delays in Social Security Fairness Act Benefits
The SSA uses automated systems to speed up payments, but some cases still need to be handled manually, which can cause delays. People with specific earnings histories or those who have previously challenged their benefit levels are typically affected by these delays.
The SSA has assured the public that all payments will be distributed timely, but if you haven’t received your adjusted benefits by April 2025, you may need to contact the SSA for support.
