The European Commission gave us a text and data mining (TDM) exception in its copyright reform proposal. A good step forward, and we applaud the fact that the exception is:

• mandatory,
• not limited to non-commercial activities; and,
• explicitly states that contractual bypasses will not be allowed.

However, the exception remains flawed at various level in order to truly unlock the potential of TDM for both the research community and businesses. We have set out 5 fundamental flaws of the TDM provision in this infographic (larger version here and PDF).
